Delhi HC insists on regular checks for fire safety violations

The Delhi High Court has mandated a more stringent observation of fire safety regulations. In a recent order, the court highlighted the necessity for the Municipal Corporation of Delhi (MCD) and the Delhi Fire Services to perform regular inspections at Azad Market.

The aim is to pinpoint and address any infringements related to fire safety norms.

The directive emanated from a public interest litigation stressing the urgency for action against unauthorised and unsafe structures that pose a fire risk.

Compliance with fire rules to be thoroughly enforced

Chief Justice Satish Chandra Sharma, leading the bench, expressed the court’s stance on the matter: “However, this Court cannot turn a blind eye towards any potential violations of Fire Norms, accordingly the MCD and the Delhi Fire Services are directed to ensure scrupulous and rigorous enforcement of the Fire Norms pertaining to premises specified under Rule 27 of the Delhi Fire Rules.”

This response is rooted in concerns raised by the Azad Market Residents Welfare Association, which noted fire incidents and resultant casualties due to non-compliant building practices.

The court’s strategy involves systematic monitoring and strict enforcement to prevent future incidents.

It was stated: “In this regard, the MCD shall endeavour to conduct regular monitoring of the Subject Area to ensure that persons found violating the Fire Norms are promptly identified and referred to the Fire Prevention Wing under Rule 34 of the Delhi Fire Rules.”

Remedial action for unauthorised constructions

When encountering isolated cases of unauthorized and illegal constructions, the court advised stakeholders to report to the Centre’s Special Task Force.

This body is charged with investigating and taking necessary actions against illicit construction and encroachments.

The court clarified: “We dispose of the present petition, with liberty to the Petitioner to approach the STF if the need so arises.”
